Frequently asked questions

View All FAQs
Who is eligible to apply for asylum in the United States?

Anyone who fears persecution or harm in their home country on account of race, religion, nationality, political opinion, or membership in a particular social group may be eligible for asylum

Can I still apply for asylum even if I don’t have formal documents proving persecution?

Yes — while documentary evidence helps, the law allows a fact-finder (USCIS or an Immigration Judge) to grant asylum based solely on your credible testimony and personal story.

If I apply for asylum, can I apply for employment authorization?

Yes. Asylum applicants may become eligible to apply for employment authorization after a waiting period, generally around 150 days after filing their asylum application. Once approved, you can legally work in the United States while your asylum case is pending.

Can I apply for asylum even though I have been in the United States for more than one year?

In many cases, yes. While asylum applications are generally required to be filed within one year of arriving in the United States, there are exceptions. You may still qualify if you can show changed circumstances that affect your eligibility for asylum or extraordinary circumstances that explain the delay in filing. An experienced immigration attorney can help determine whether an exception applies to your situation.

Why is hiring an experienced immigration lawyer important when applying for asylum or if I am in immigration court?

Asylum cases and immigration court proceedings can be complex and detailed. Many forms of relief may apply, and in some situations your testimony alone may determine the outcome. An experienced immigration lawyer can prepare your case, gather supporting evidence, identify all potential avenues for relief, and represent you effectively in front of USCIS or an Immigration Judge. This significantly improves your chances of a successful result.
